This Privacy Policy explains how Impact Performance Sdn. Bhd. (Company/SSM Registration No. 1677679-U), registered address at 10, Jalan BK9/2, Bandar Kinrara, 47180 Puchong, Selangor, Malaysia ("Langga", "we", "us", "our") collects, uses, discloses, and protects personal data in connection with the Langga website at langga.com (the "Website") and our work with Langga-certified dental clinics, in accordance with the Personal Data Protection Act 2010 ("PDPA") as amended by the Personal Data Protection (Amendment) Act 2024.
1. Who This Policy Covers
This Policy applies to: (a) visitors to the Website; (b) patients who are scanned and fitted for a Langga mouthguard at a Langga-certified clinic, whose data is shared with us by the clinic for manufacturing purposes; and (c) parents or guardians acting on behalf of a minor patient.
2. Personal Data We Collect
(a) Data you give us directly through the Website
If you contact us, use a "find a clinic" enquiry form, or sign up to hear from us, we may collect your name, email address, phone number, and the content of your message.
(b) Data collected automatically
The Website currently does not use non-essential cookies or third-party analytics or advertising trackers. We may in future add tools such as website analytics; if we do, we will update this section to describe what is collected (for example, IP address, browser/device type, pages visited) and, where required, seek your consent before non-essential cookies are set.
(c) Data we receive from Langga-certified clinics
When you visit a Langga-certified clinic for an intraoral scan and fitting, the clinic collects your name, contact details, and a digital scan of your teeth/mouth, and shares the scan and associated details with us so that we can design and manufacture your custom mouthguard. This data is collected by the clinic directly from you (or, for a minor, from your parent/guardian), and the clinic is responsible for obtaining your consent to that collection and to sharing it with us, as part of its own patient intake process.
3. Sensitive Personal Data (Health Data)
Your intraoral scan and any related dental/health information are "sensitive personal data" under the PDPA. We only receive and process this data for the purpose of designing, manufacturing, and quality-checking your custom mouthguard, and for related warranty or after-sales support. We do not use your scan or health data for marketing, and we do not sell it to any third party. Your clinic is responsible for obtaining your explicit consent, at the point of scanning, for this data to be shared with and used by Langga for these purposes.
4. Children and Minors
Minors are common users of Langga mouthguards, particularly for youth contact sports. Where the patient is under 18, we rely on the Langga-certified clinic to obtain the consent of a parent or legal guardian before the minor's scan and personal data are collected and shared with us. 5. Why We Use Your Data
We use personal data to: design and manufacture your custom mouthguard; communicate with our certified clinics about your order; respond to enquiries submitted through the Website; maintain records for quality control, warranty, and after-sales support; and comply with our legal obligations.
6. Legal Basis for Processing
We process personal data on the basis of: consent obtained by you (or your parent/guardian) via the clinic at the point of scanning; the necessity of processing to fulfil our manufacturing arrangement with the clinic acting on your behalf; and our legitimate interests in providing after-sales support and improving our products, balanced against your rights.
7. Who We Share Data With
We may share personal data with: the Langga-certified clinic that referred you, for coordination of your order and fitting; couriers or logistics providers, to deliver the finished mouthguard to your clinic; IT, hosting, and administrative service providers who support our operations, under confidentiality obligations; and regulators or authorities where required by law. We do not sell your personal data to third parties.
8. Cross-Border Data Transfer
Some of our service providers (for example, website hosting) may store or process data outside Malaysia. Where we transfer personal data outside Malaysia, we do so on a lawful basis recognised under the PDPA — such as transferring to a jurisdiction with comparable data protection standards, obtaining your explicit consent, or where the transfer is necessary to perform our arrangement with your clinic on your behalf — and we take reasonable steps to ensure the data remains protected.
9. Data Retention
We retain personal data, including scan data, only for as long as necessary to manufacture your mouthguard and to support any warranty, quality, or after-sales matters, after which it is securely deleted or anonymised, unless we are required to keep it longer by law.
10. How We Protect Your Data
We use reasonable technical and organisational measures — including access controls and secure storage — to protect personal data against loss, misuse, and unauthorised access, in line with the PDPA's Security Principle.
11. Cookies
The Website currently uses only cookies strictly necessary for it to function (for example, those set by our hosting platform). We do not currently use analytics or advertising cookies. If this changes, we will update this Policy and, where your consent is required, seek it before setting non-essential cookies.
12. Your Rights Under the PDPA
Subject to the PDPA, you have the right to: request access to the personal data we hold about you; request correction of inaccurate data; withdraw your consent to processing (which may affect our ability to manufacture or support your mouthguard); request data portability, where technically feasible; and lodge a complaint with the Department of Personal Data Protection (Jabatan Perlindungan Data Peribadi) if you believe your data has been mishandled.
